Terms and Conditions

Subject to any statutory rights of refund (including, without limitation the provisions of the Australian Consumer Law), if an event takes place then generally there is no right to a refund or exchange, including where a ticket holder cannot attend because of adverse weather conditions (eg rain) or due to ‘change of mind’.  Transfers for group bookings will not be accepted within 21 days of the booked fishing charter. Transfers for individual tickets will not be accepted within 14 days of the scheduled trip.  Last minute cancellations (ie within 14 days of a confirmed trip) will be classified as a ‘no show’. No shows cannot be transferred or refunded. 

It is important that you provide us with correct contact information ie mobile phone and email address at the time of booking. Should your fishing trip need to be cancelled or postponed due to weather, rough seas or other circumstances beyond our control, an SMS and/or email notification will be sent to to the contact details provided at the time of booking (or your group contact person if a group booking). We will endeavour to transfer your booking to a mutually agreed alternative date (subject to availability).  We reserve the right to transfer you to an alternative vessel at our discretion.

Spectators are welcome to share a rod with someone in their group who has paid full fare (and been provided with a rod), but will not be allocated a rod of their own. BYO rod is not available for spectators. 

Note that all public trips (where individual tickets/vouchers are purchased) are run subject to minimum numbers. If the minimum numbers are not met two days prior to the scheduled trip, you will be rescheduled to the next available date and notified by SMS and/or email.

Gift Vouchers are transferable, but cannot be redeemed for cash. Vouchers must be redeemed (ie a trip booked) within 12 months of the purchase date or they will be invalidated.

If you are deemed to be intoxicated or under the influence of any substances, the skipper reserves the right to refuse boarding. No refund will be provided in this instance.

Any damage to the vessel or equipment including damage to rod or reel, or loss of rod/other equipment over the side of the vessel will become the financial responsibility of the Charterer (or individual, where applicable) and may result in the cruise being terminated on the spot without refund. The credit card on file will be billed for the replacement value of the lost or damaged item/s plus any additional costs eg delivery, legal costs and an admin fee. There is 24 hour video surveillance onboard for the safety of the crew, guests and the vessel itself. Footage will be handed over to the Police on request.

It is inferred that the holder of the ticket/any passengers booked on the charter voluntarily acknowledges and assumes all risks related in any way to the trip (including, without limitation, risks of personal injury, property loss and/or damage) arising or resulting from any cause whatsoever (including, without limitation, by crew, other passengers, spectators, objects and other inherent risks incidental to the event and negligence) and whether occurring prior to, during or after the event. Any personal items eg cameras, mobile phones, tablets or other valuables are brought on at your own risk. TCP Marine, its crew and any subcontractors are not responsible for damage to or loss of personal items prior to, during or after the trip. We are not a common carrier and will accept no liability as such.  

The Master of the vessel reserves the right to change or vary the agreed course at their sole discretion at any point during the trip if they believe it is in the best interests of the group in regards to the comfort and safety of passengers, crew and/or other vessels in the area.

The duration of the charter is inclusive of the time required to embark and disembark passengers. Pick up from public wharves is available for Private Charters, however the Charterer acknowledges that any delays incurred due to the vessel having to give way to scheduled services (eg Ferries, Rivercats) cannot be added to the end of the cruise.

Fishing is a sport. It is a mixture of individual skill, using the right equipment, access to technology, and a fair bit of chance when it comes to mother nature. While Sydney Fishing Tours provide knowledgeable staff, quality gear, and use the latest technology onboard to put you over the fish, we cannot guarantee that any fish will be caught. Note that our priority on the day is fishing, so during whale watching season the chance to see a whale will occur as a by-product of being offshore. You’re welcome to book a private whale watching trip if whale watching is your priority. 

Please note that actual shotguns (converted to laser) are used for the Laser Clay shooting activity. These guns should be treated as real shotguns. Pointing the guns at passing boats, aircraft, other people or using them in an unsafe manner will result in both the activity and cruise being terminated immediately without refund.

Dogs (or any other animals) – with the exception of an assistance animal – are not permitted onboard.

We reserve the right to update or amend the terms and conditions from time to time in order to comply with new legislation or company policies. By booking a trip you acknowledge and accept these terms and conditions in your personal capacity and on behalf of any accompanying minor.
